Advice on Islamic Wills
We provide advice on the essential and optional aspects of an Islamic Will. We will inform you of the important matters to comply with to ensure that your Will remains valid and legally applicable in England & Wales. We will also advise you on aspects of the Will Law to avoid, so that the Islamic conditions are not compromised.
Initial consultations are offered free of charge for up to 15 minutes. Charges apply for subsequent consultations.
Legal Islamic Wills
We provide you with an Islamic Will that is tailored to your needs, compliant with the Islamic Law contained in the Shariah according to the Holy Quran and the Sunnah of the Prophet Muhammad ﷺ. It is also compliant with UK Will regulations to ensure that your wishes remain legally binding.
As it is our aim to ensure that every Muslim has a Will, we offer an easy payment option (if needed) to make it accessible to all.
Islamic Codicils and Revocation clauses
We provide you with advice and guidance on amendments to your existing Will to avoid it becoming invalidated unintentionally.
As your circumstances change you may need to update your Will to reflect a new spouse, child or change of health condition, for example.
Any changes or revocation clauses, we make with you, will be legally binding and will only affect specific clauses in the original Will.
Inheritance Tax Planning
We provide advice and guidance on the the various methods of mitigating inheritance tax on your estate including the use of trusts.
Our inheritance tax planning specialist will arrange a customised legal financial plan as part of your Will to ensure that any inheritance tax burden is reduced or eliminated, so that your heirs receive all or most of your estate.
Power of Attorney Applications
With our experience and contacts at the OPG, we make Power of Attorney applications easy for you and your loved ones.
Whether you are concerned with deteriorating physical health and the risk of loss of mental capacity, we will guide you to the best power of attorney solution for your particular situation to empower a trusted person of your choice to be able to make critical decisions on your behalf concerning your health or finances.
Independent Signatory and Witness service
To finalise and validate your Will, you must sign it, in the presence of two independent witnesses. The witnesses must satisfy the mandatory conditions to allow them to be a valid signatory. If these conditions are not met, the Will may not be valid.
These conditions will be explained in detail, when you receive your Will document.
If you are unable to find suitable witnesses that satisfy the conditions or you just wish to keep your Will document private, we can provide you with the required witnesses for signing.
Grant of Probate Applications
We perform the searches, make the notifications and applications necessary to obtain a Grant of Probate. This includes an assessment of assets, debts and inheritance tax liability which are all required before the grant is awarded.
Once received this allows the executor/s the legal right to access the financial accounts and policies of the deceased in order to dispose of the estate in accordance with the testators Will.
As advisors to the executors we also provide Islamic advice on the shariah distributions to be followed.
Although executors are usually family members, Shariah Wills may provide this service for you where required.
